O'Hara eyes a new court challenge
Irish Echo This story appeared in the issue of December 8-14, 2004 By Ray O'Hanlon Court cases can outlive a thumbs-down from the U.S. Supreme Court. And this little known fact may be giving Brooklyn man John O'Hara his ninth legal life. O'Hara has waged a tenacious battle against his conviction for voting fraud. But he was stopped in his tracks earlier this year by the nation's top court when it decided not to consider his appeal. But O'Hara's legal battle is poised to go one more round. And he might be holding in his hand the same kind of ammunition used against him by the office of Brooklyn District Attorney Charles Hynes.
A story in the December issue of Harper's Magazine reports that evidence since uncovered in the case points to a "selective" or "malicious" prosecution of O'Hara, the first American to be prosecuted and punished for voting fraud since Susan B. Anthony in 1876.
